3. SMS Messaging
This section explains how Lead Rescue uses phone numbers collected through our website and the consent terms for SMS communications.

Lead Rescue is a Business-to-Business (B2B) service. We send SMS in two distinct contexts:
- To prospective and current business customers — i.e., agency owners who have contacted Lead Rescue. Messages are limited to demo scheduling, onboarding, and account-related communication. Consent is obtained when you submit the contact form on this site, explicitly agree to receive SMS messages via a required checkbox, and review the SMS disclosure displayed directly beneath the phone number field.
- To end-consumers of our business customers — i.e., leads of our customers' clients. In this case, Lead Rescue sends messages on behalf of our customer, under the customer's brand, following the customer's own consent-collection processes. Our customers warrant that they have obtained proper opt-in consent from their leads before those leads' phone numbers are passed to the Service.
4. How we share information
We share information only in limited circumstances:
- Service providers / sub-processors: Infrastructure partners that help us run the Service (e.g., Twilio for SMS, Google Cloud and HubSpot for workflow execution, Anthropic for AI reply parsing, payment processors for billing). These providers are contractually limited to using the data only to provide services to Lead Rescue.
- Legal & safety: When required by law, legal process, or to protect the rights, property, or safety of Lead Rescue, our customers, or others.

B2B Service
Lead Rescue is a business-to-business service. The Service is intended for use by companies and their authorized representatives, not by individual consumers. If you are using the Service, you represent that you are authorized to do so on behalf of a business.
1. The Service
Lead Rescue provides speed-to-lead automation infrastructure — software and workflows that capture inbound leads, send SMS and email on behalf of our customers, parse replies using AI, and book meetings on connected calendars. Features may evolve over time.
2. Accounts & customer responsibilities
If you create an account or enter into an engagement with Lead Rescue:
- You agree to provide accurate information and keep it up to date
- You are responsible for all activity on your account and for keeping credentials secure
- You are responsible for obtaining all consents required by law from the leads whose phone numbers and personal data you submit to the Service
- You will not use the Service to send messages in violation of the TCPA, CAN-SPAM Act, CASL, GDPR, or any other applicable law
- You will comply with the policies of messaging carriers and platforms (including The Campaign Registry / A2P 10DLC rules)
3. Acceptable use
You agree not to:
- Use the Service to send spam, unsolicited messages, or prohibited content (including but not limited to content related to illegal substances, firearms, loans of last resort, hate speech, or fraud)
- Impersonate any person or entity, or misrepresent your affiliation
- Interfere with or disrupt the Service, including by attempting unauthorized access or by probing for vulnerabilities without written permission
- Use the Service to build a competing product or to reverse engineer our systems
- Use the Service in any way that violates applicable law
4. SMS Messaging Terms
By providing your phone number and opting in through our contact form or otherwise engaging with our SMS program, you agree to the following SMS-specific terms:
- Program name. The program name is Lead Rescue.

If you purchase a paid plan, pricing and billing terms will be specified in your order form or on the pricing page in effect at the time of purchase. Fees are non-refundable except as required by law or as expressly stated in your agreement. Third-party charges (e.g., Twilio messaging fees) may apply separately and are your responsibility unless explicitly included in your plan.
6. Intellectual property
Lead Rescue retains all rights, title, and interest in the Service, including all software, content, workflows, templates, and trademarks. You retain all rights to the data you submit through the Service. You grant us a limited license to use that data solely to provide the Service.
7. Confidentiality
Each party agrees to protect the other's non-public business information disclosed in connection with the Service with at least the same degree of care it uses for its own confidential information, and to use it only for purposes of the engagement.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or if we discontinue the Service. Obligations that by their nature should survive termination (including payment, confidentiality, IP, disclaimers, and limitations of liability) will survive.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Lead Rescue does not guarantee specific response rates, booking rates, or business outcomes.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEAD RESCUE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU TO LEAD RESCUE IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD IF YOU HAVE NOT PAID ANYTHING.
11. Indemnification
You agree to defend, indemnify, and hold harmless Lead Rescue from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party rights — including claims that you failed to obtain proper consent from leads whose phone numbers you submitted to the Service.
12. Governing law & disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in New York, NY, and the parties consent to exclusive jurisdiction there.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and notify customers through reasonable means. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
